1. Acceptance of Terms

By accessing or using The Training Dynamic platform ("Platform"), operated by healthydynamics.ai, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Platform.

These Terms apply to all users of the Platform, including coaches, trainers, and any other professionals who access our services.

2. Platform Use

The Training Dynamic grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your professional coaching and training activities.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform
• Use the Platform to distribute malware, spam, or harmful content
• Scrape, crawl, or systematically extract data from the Platform without written permission
• Impersonate another person or misrepresent your professional credentials
• Use the Platform to provide services for which you are not qualified or licensed

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You must provide accurate, current, and complete information when creating your account. You may not create accounts on behalf of others without their explicit consent.

4. AI Tools — Important Limitations

By using our AI features, you acknowledge that:

• AI-generated programs and recommendations are starting points that require your professional review and judgment before delivery to clients
• The AI may make errors and does not replace your professional knowledge and expertise
• You are responsible for ensuring any program or recommendation is appropriate for each specific client, including considering any health conditions, injuries, or contraindications
• You hold appropriate certifications and qualifications for the coaching services you provide
• You have obtained any necessary client consents for health data collection and program design

5. Your Content

You retain ownership of all content you upload to the Platform — including client data, programs, notes, and communications. By using the Platform, you grant The Training Dynamic a limited license to process and store that content solely for the purpose of providing you with the Platform's services.

You represent that you have all necessary rights and consents to upload client data to the Platform, including compliance with applicable privacy laws in your jurisdiction.

6. Subscriptions & Payment

Access to The Training Dynamic requires a paid subscription. Subscription details, pricing, and billing cycles are provided at the time of purchase and are subject to change with reasonable notice.

Subscriptions renew automatically unless cancelled before the renewal date. To cancel, you may do so at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

All payments are processed securely by Stripe. We do not store complete payment card information. Refund requests are evaluated on a case-by-case basis — contact us within 14 days of a charge if you believe an error has occurred.

7. Intellectual Property

The Training Dynamic platform, including its design, code, AI models, and proprietary methodology, is owned by The Training Dynamic and protected by intellectual property laws. Nothing in these Terms grants you ownership of any part of the Platform.

The training programs and content generated by our AI using your input become your property upon generation, subject to the license granted in Section 5.

8. Disclaimers

The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's reliability, accuracy, or fitness for a particular purpose.

We do not warrant that AI-generated content is error-free or suitable for every client situation. You are responsible for reviewing all AI outputs before acting on them.

9. Limitation of Liability

To the maximum extent permitted by law, The Training Dynamic shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including any decisions made in reliance on AI-generated content.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Platform in a manner that harms other users or third parties.

Upon termination, you may export your data for up to 30 days before it is permanently deleted. We will notify you before deletion occurs.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in San Francisco, CA, except that either party may seek injunctive relief in a court of competent jurisdiction.
